It will be at least a couple of months before residents of the Boca Del Mar community will learn whether their view will be green space or more housing. The owners of Mizner Trail Golf Club, located within the Boca Del Mar community west of Boca Raton , sued Palm Beach County in 2006 alleging that the county essentially condemned the golf course but failed to pay just compensation for doing so. Boca Del Mar, located west of Boca Raton , is home to some 25,000 residents. Just fewer than 10,000 homes, both single and multi-family units, are situated on the community's 19,000 acres. Two golf courses, the private Country Club at Boca Raton and the semi-private Mizner Trail Golf Club, also sit within the community. In 2005, Mizner Trail closed its course because after saying it was losing money and that a deed restriction expiring in 2012 allows the land to be developed for other use. Mizner Trail contends that it bought the property in 1998 with the expectation that it would temporarily be a golf course and ultimately developed residentially. Over the past several years, Mizner has submitted several development plans to the county, the first to build 390 units, the second for 236 units and finally for 202 units. Mizner's lawsuit contends that their applications not only met code requirements but exceeded minimum requirements for landscaping, buffering, open space, recreation and traffic. The county repeatedly rejected Mizner's applications and Mizner believes the county made them jump through extra hoops in the application process and that 'the county will not permit use of the property other than for open space or recreation,' the lawsuit states. Mizner Trail accuses the county of so-called 'inverse condemnation,' which is when the government takes private property but fails to pay just compensation required by the state constitution. This particular case involves what's known as 'regulatory taking'
